Trial Of John Dolson
Int: Madam Ellis's Gambling Hall-Next Morning-9 A.M.
Narrator
"Everyone getting seated in the make shift courtroom. One table stacked on top of another, covered with a blanket to make for Judge Timmons bench. Two ladders opposing each other with a piece of wood slid between the third set of steps provide the high seat for the judge to sit on."
Deputy Mike seeing Judge Timmons arriving from upstairs, with Tomei following him from her room, taking a seat at one of the tables.
"The Honorable Judge Timmons is entering the room, will everyone please rise...welcome to Dolson sir!"
Everyone trying to stand up, many who have clearly had too much to drink.
Judge hopping up on high seat, taking Gavel out of carry bag.
The Wells Fargo driver and his shotgun companion who were there for the attempted hold up show up and are seated at the witness table.
The Sheriff shows up with John Dolson in chains, Deputy Mike assisting him to a chair and seats him.
Judge Timmons knocking Gavel on table top
"Court is now in session, in the case of the State of Kansas, Wells Fargo Company, and the the citizens of Dolson, Kansas against John Dolson...opening comments Sheriff?
Sheriff standing up
"Well your honor, this trial is to prove that John Dolson, is being accused of conspiring and masterminding the attempted stage hold up of the 4 P.M. Wells Fargo Stage right outside of Dolson on the Oregon Trail of Gold bars, Silver coins, and unregistered stock certificates...not only do we believe that he hired 6 outlaws and paid them in advance to carry off the heist, but he was also planning to have the driver and shotgun assistant murdered, as to not leave any witnesses to the crime..."
Dolson attempts to stand up and interrupts
"That's not true...just made up lies!"
Dolson looking around, all eyes on him as he slowly sits down.
Judge chuckling
"Well...self incrimination is always welcomed in the courtroom...kinda speeds things up...continue Sheriff..."
Sheriff
"And in the process, a strange situation occurred, either spiritual or perhaps a freak of nature where all 6 men inexplicably were injured or attacked by creatures and through the mishap all 6 resulted in bodily death to all the individuals which Dolson had hired to commit the hold up...we know of these things as they were staying at Madam Ellis's Hotel, and we were able to retrieve all the invitations to the scheme from Western Union's log book."
Judge
"I'd like to call Madam Ellis to the bench please..."
Madam Ellis comes forth
"Yes, your honor..."
Sheriff approaches
"So, is it true Madam Ellis that you over heard the plan being discussed over the poker table and at other various times?"
Madam Ellis
"Yes Sheriff, but at first I wasn't sure that it was a hold up, they made it sound more like he was getting them...say conspire to rob his own bank or something...wasn't till it actually happened that all started to make sense...
Sheriff
"Thank you Madam Ellis, you may sit down."
Judge
"Would like to call Dale Erwin...driver for the Wells Fargo stage, please come forth sir!"
Sheriff
"Since you were first to see what was happening, did this appear to have been staged, was this attempt a commanded operation in your opinion...anything unusual?"
Dale (Driver)
"The whole thing seemed so conspired and set up, like everyone was in their places, but they didn't seem to be as organised...I've been robbed before, but when they did put on an attack, all them critters started attacking them...so weird!"
Sheriff
"So, you couldn't really say what happened, but did you recognize or know any of these people previously?"
Dale
"Well sure, I've been doing drops at Dolson's bank for a couple of years now, these were business friends of his...I knew almost all of them!"
Dolson squirming and clanking in his chains
Sheriff
"Thank you very much Dale, you may sit down, thank you!"
Judge Timmons knocking Gavel and pointing at Dolson
"You hush down over there sir...continue Sheriff..."
Sheriff
"And finally, I would like to request the presence of Tomei, and see how she feels about all this...anything spiritual come to mind young lady
Tomei stands and timidly approaches bench
Sheriff
"Now Tomei, the reason I have asked you to come forth, is that you seem to be the only person who had knowledge from whatever that magical source is, that this hold up would be attempted...I remember you coming to my office and warning me...that you were going to take your spells and prevent the men from completing these evil task...I'm only asking, because you seemed to preempt their actions through your spirit world...what do you say?"
Tomei
"First off, I could see the terrible things that could have happened...as though they had already happened...I could have ignored those visions, or I could have reacted to them...I told you what was in my vision and you didn't listen at first, or because I'm just a girl, but you came around and reacted...and I appreciate that, but you waited so long that it was too late for you to help really...so I did what I had to do...that's all, believe what you want!"
Sheriff looking down
"But, all this spiritual stuff is new to me...you feel something and you must respond, right?"
Tomei
"I can't explain it but it's real to me and they up there they exist (looking around room), for all of us...life goes on after we leave here, and when you become a spirit, if your offered to do so, you can help us down here...(the crowd gasp, pointing fingers at Tomei), but I can't explain how it all works, but they are here for me...for all of us...just believe and only request something when nothing else will do!"
Judge interrupts
"Okay Tomei...do you feel in your heart that this man, this John Dolson over here conspired and planned the attempted hold up of the Wells Fargo stage that day?"
Tomei
"Oh, no doubt...he's done lot's of bad things, including taking me away one night...wasn't gonna bring it up, but he took me away without my permission, I was truly kidnapped...but he didn't do nothing, got back without a scratch...only Madam Ellis yelled at me for being late...nothing else!"
Judge
"But, getting back to my first question, do you feel that he should be prosecuted here in this courtroom...today as we speak?"
Tomei laughing
"It's hard to think this a court room, as all I ever see is men drinking, playing cards, and falling down a lot (Everybody laughing)...however, it's his town, he started it...he got greedy and tried to save himself from some bad decisions and deals he made...fact is, nobody else here understands the business of banking and running a town like Mister Dolson does!"
Dolson in chains looks up and starts to tear up
Sheriff
"So, are you suggesting what I think your suggesting?"
Tomei smiling
"I'm saying that until you can find someone as qualified as Mister Dolson to run his town, that you allow him to run it...he's got demons, but I think I can vanish them if he would allow me...the Bible says to forgive, and the spirit world, if you choose to believe them, says to give this man another chance to make good...and that's the truth your honor!"
Sheriff mumbling to Judge
"Timmons, I told you this was going to be a stretch...can we really do something like that, just look the other way?"
Timmons mumbling back to Sheriff
"I don't want to get into any trouble here, but let's ask Dolson, see if there's any remorse...go ahead!"
Sheriff turning to Dolson
"Hey John, how do you feel about this, you think you up to starting over, getting better about yourself?"
John Dolson crying
"I...don't know what to say...I can try to be good...no really...try to be good...what is it about this little girl that makes me so ashamed of everything that I have done...but I believe her spirit world...I know I could be better...yes, yes I can!"
Tomei looking at Judge, hands up in expressive "whatever"
Sheriff looking at Tomei shaking his head.
Judge grabbing Gavel
"I have been doing judicial hearings and trails for over ten years now...thought I'd seen and made decisions on all, well...just about everything that I could take part in...but this is...how you say it Sheriff?"
Sheriff
"Legendary...one for the history books!"
Judge
"Yes, yes...of course...legendary...and so, I'm going to rule that we suspend any decision on this man's fate for the period of 90 days, three months...and we'll see how Tomei, who will have him in her spirit world...she's too young to be put in her custody, how old is she anyway?"
Sheriff
"She's only 15, but I can preside over the visits, did you wish to mandate something?"
Judge
"Whoa, a very mature 15 might I say...okay well, here's the deal John...you will agree to see Tomei with the Sheriff twice a week for three months, and we'll meet back up and see how you do...what you say about that?"
Dolson shaking head enthusiastically
"Yes, oh yes your Honor, thank you Miss Tomei, bless you, you fix me right huh?"
Tomei blushing
"Why Mister Dolson, I can take that bad man out of you...make you proud of yourself again...I'll do what I can!"
Judge
"This court is adjourned...Miss Ellis, let's get some drinks going here, I think I got a splinter in my butt...where did you'all get this wood from...dang!"
(Everybody Laughing and Clapping)
Sheriff starts unchaining Dolson
Tomei comes over to Dolson and kisses him on the cheek
"Now just believe and it will happen...you understand?
Dolson covered in tears
"Yes Mam, I understand...thank you for believing in me!"
Tomei laughing
"Don't thank me (pointing up), thank them up there...I'm just the messenger!
Sheriff looking up, then back down at Dolson
"Yea, if I were you...get in good with them...do us all a little good...right Tomei?"
Tomei
"Right Sheriff...do us all a little good...might just get this town working right after all!"
(Scene Close)
Tomei
